Terms of Service

1. Definitions
“BoreCast”, “we”, “our”, or “the Service” means DrillerDB BoreCast, a subsurface planning product operated by DrillerDB (“DrillerDB”). “You” means the individual or entity that creates an account or otherwise uses the Service. “Content” means any profile, corridor analysis, report, or output the Service generates in response to your queries. “Upstream Data” means publicly available well-log records, soils-survey data, and other third-party datasets that BoreCast queries to generate Content.
2. Use of the Service
You may use the Service to plan horizontal directional drilling bores, evaluate subsurface conditions, and generate supporting reports for your own projects or those of your clients. You agree not to misuse the Service, including by attempting to reverse-engineer it, scraping at a volume that is inconsistent with normal use, reselling the raw output under another brand without a written agreement, or using BoreCast to build a competing subsurface product. You are responsible for the accuracy of the coordinates, geometries, and job parameters you submit.
3. NOT a substitute for 811 / Call Before You Dig
BoreCast is a subsurface planning tool. It is nota utility locate, a one-call ticket, or a substitute for contacting your state’s 811 one-call center before excavation.
You must contact your state one-call center and obtain a valid locate ticket before any digging, boring, trenching, or other subsurface work. Utility line overlays, where rendered, are advisory only and do not replace a physical locate. Failing to call 811 can result in property damage, service outages, serious injury, or death, and may violate state law.
By using BoreCast you acknowledge that the Service does not know the actual location of buried utilities, that Upstream Data and our derived Content may be incomplete, outdated, or wrong, and that you are solely responsible for verifying subsurface conditions in the field before any physical work.
4. Subscription terms
BoreCast is offered as a recurring subscription. Paid plans bill automatically in advance on a monthly or annual basis at the price in effect when you subscribed. Pricing, limits, and included features may change over time; material changes will be communicated by email at least 30 days before they take effect. Free-tier usage is capped at three queries per 30-day window per account and is provided on an as-is basis with no service-level commitment. Free trials, when offered, require a valid payment method on file and convert to the paid tier at the end of the trial unless canceled before the trial ends.
5. Cancellation and refunds
You may cancel your subscription at any time from the billing portal. Cancellation takes effect at the end of the current billing period; you will retain Pro access until that date. We offer a 14-day unconditional refund on your first payment: if you email craig@drillerdb.com within 14 days of your first charge, we will refund it in full, no questions asked. On subsequent monthly billing cycles, refunds are prorated per Stripe’s standard process for the unused portion of the current period.
6. Limitation of liability
The Service and all Content are provided “as is” and “as available” without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, DrillerDB and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or damage to buried utilities, structures, or equipment arising from your use of the Service or reliance on Content. Our aggregate liability for any claim arising from the Service is limited to the greater of one hundred US dollars or the fees you paid to DrillerDB for BoreCast in the twelve months preceding the event giving rise to the claim.
7. Indemnification
You agree to defend, indemnify, and hold harmless DrillerDB and its officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or property right; and (d) any physical work performed by you or on your behalf in reliance on Content, including any damage to buried utilities or property.
8. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access to the Service, with or without notice, if you materially breach these Terms, if we are required to do so by law, or if we reasonably believe your use of the Service poses a security, legal, or reputational risk. Sections 3, 6, 7, and 9 survive termination.
Subject to applicable law (including the EU General Data Protection Regulation and the California Consumer Privacy Act), you have the right to access, rectify, delete, and export the personal data we hold about you. 9. Governing law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or from your use of the Service will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction and venue in those courts.
